Terms of Use
1. Who We Are — And What BeatBullies Is (Please Read This First)
Welcome to BeatBullies. These Terms of Use ("Terms") are a binding agreement between you and Educated Guess Ventures, LLC d/b/a BeatBullies ("BeatBullies," "we," "us").
BeatBullies provides software tools — not legal services. We are not a law firm, we are not lawyers, and we do not provide legal advice or legal representation.
By creating an account or using BeatBullies, you acknowledge and agree that:
- You are representing yourself. BeatBullies helps you organize your own evidence, understand general information about consumer disputes, and draft letters that you review, approve, and send yourself. Every output of the software is software-generated and user-controlled. You remain solely responsible for all legal and factual decisions about your dispute.
- No attorney-client relationship is created between you and BeatBullies, its owners, employees, or contractors — by using the service, communicating with our AI features, or in any other way. No employee, contractor, AI system, chatbot, or support representative of BeatBullies is authorized to provide legal advice. Customer support can explain how the software works; it cannot recommend legal strategies or tell you what to do in your dispute.
- No fiduciary or other special relationship is created. Nothing in these Terms creates any fiduciary, agency, partnership, joint venture, employment, or attorney-client relationship between you and BeatBullies.
- We provide legal information, not legal advice. The legal reference material in BeatBullies (statutes, protections, and explanations) is general educational content drawn from a curated library reviewed by licensed attorneys. It describes what the law generally provides; it is not advice about what the law means for your specific situation. No attorney reviews your individual case, documents, or letters.
- We do not predict outcomes. Nothing in BeatBullies — including any score, assessment, or coaching — is a prediction that you will win, recover money, or achieve any result. Readiness scores measure only how complete and organized your file is.
- We do not act without you. BeatBullies never contacts companies, sends letters, or takes action toward any third party on your behalf except where you explicitly authorize a specific action (such as the optional paid mailing service, which mails only a letter you have reviewed and approved, on your specific instruction).
- If you need legal advice, consult a licensed attorney. Some situations genuinely require a lawyer — including if you are sued, face imminent legal deadlines you don't understand, or have a complex or high-stakes claim.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use BeatBullies. By using the service you represent that you meet these requirements.
3. Your Account and Security
You are responsible for your account credentials and for all activity under your account until you notify us of a compromise. Provide accurate information and keep it current. We offer security features such as multi-factor authentication, and we strongly encourage you to enable them. Do not share your credentials with anyone. Notify us immediately at support@beatbullies.com if you believe your account has been compromised or used without authorization — you remain responsible for activity on your account until you report it.
4. The Service — What BeatBullies Does
BeatBullies provides software that helps you:
- Upload and organize documents related to a consumer dispute;
- Extract and confirm facts (dates, amounts, parties) from your documents — you confirm all facts; the software does not treat unconfirmed extracted information as true;
- View general educational information about how disputes like yours typically proceed and what legal protections consumers commonly reference;
- Draft dispute letters and related documents that you review, edit, approve, and send yourself;
- Track deadlines calculated by fixed rules;
- Optionally, purchase per-letter physical mailing of a letter you have approved (Section 9).
AI-generated content — read this carefully. Portions of the service use artificial intelligence to organize information and draft text. AI systems have known limitations. Among other things, AI may:
- generate information that sounds plausible but is wrong ("hallucinate");
- omit facts that matter to your situation;
- misread or misunderstand documents you upload;
- generate inaccurate or nonexistent legal citations; and
- produce inconsistent outputs from the same inputs.
AI output is only a draft for your review. Automated safeguards are applied to AI output, but no automated system is perfect. Nothing generated by the service is legal advice.
Your responsibility. The letters and documents you send are yours. Before you use or send anything generated by the service, you are responsible for:
- verifying every fact, date, and amount;
- verifying names and addresses;
- verifying any statute, regulation, or legal protection referenced;
- verifying deadlines that matter to your situation;
- deciding whether to send anything at all; and
- deciding whether your situation requires a licensed attorney.
Do not use BeatBullies to make false statements to any person or company. Everything you send must be truthful and accurate.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose, or to harass, threaten, or defraud anyone;
- Submit false information or fabricated documents;
- Attempt to probe, breach, or circumvent security or access controls, or access another user's data;
- Conduct security testing of the service without our prior written authorization;
- Introduce malware or other harmful code, or engage in denial-of-service attacks or other conduct that disrupts the service;
- Attempt to manipulate the AI features into producing prohibited output (including through prompt injection), or attempt to access the underlying AI models outside the service's intended functionality;
- Use automated means to scrape, bulk-access, or bulk-download the service, or create accounts by automated means;
- Reverse engineer, decompile, or disassemble the service, except where such restriction is prohibited by law;
- Benchmark the service or publish performance comparisons without our prior written permission;
- Share account credentials or resell or provide the service to third parties as your own offering, or use it to provide legal services to others;
- Infringe anyone's intellectual property or privacy rights.
AI misuse. In addition, you must not use BeatBullies to:
- generate fraudulent, deceptive, or bad-faith letters or claims;
- impersonate a government agency, law firm, or any person or entity you are not;
- threaten, intimidate, or extort any third party;
- fabricate evidence or misrepresent documents; or
- create or submit forged documents.
We may suspend or terminate accounts that violate these Terms.
6. Your Content and Documents
You own your content. Documents you upload, facts you provide, and letters generated for you from your information are yours.
License to operate the service. You grant us a limited, non-exclusive license to host, process, display, and transmit your content solely to provide the service to you (including processing documents through AI systems and, if you purchase mailing, transmitting your approved letter to our print/mail vendor).
We do not sell your personal information. See our Privacy Policy (Section 18) for full details on how your data is handled, retained, and deleted.
7. Feedback
If you send us feedback, suggestions, or ideas about the service, you agree that we may use them without restriction or compensation to you. This does not apply to your dispute content, which remains yours and is used only as described in Section 6 and the Privacy Policy.
8. Fees and Payments
Portions of the service may be offered free; certain features (such as physical mailing) are paid per use, with prices shown before you authorize any charge. Payments are processed by third-party payment processors; we do not store full card numbers. Except as expressly stated (including the mailing cancellation window in Section 9) or required by law, fees are non-refundable.
9. Optional Mailing Service
If you purchase mailing, you authorize BeatBullies to transmit the specific letter you approved to a third-party print-and-mail vendor and to mail it to the recipient you confirmed, at the service level you selected. You may cancel within the cancellation window shown at purchase (currently one hour), for a refund; after that window, the mailing is committed and non-refundable. You are the sender of the letter. Delivery times and postal handling are outside our control.
10. Third-Party Services
The service relies on third-party providers (hosting, AI processing, payments, printing/mailing, communications). We are not responsible for third-party services' acts or omissions, though we choose vendors with care and bind them to appropriate obligations as described in our Privacy Policy.
11. Intellectual Property; License to You
The service — including software, design, branding, the Buster character, and our content library — is owned by BeatBullies or its licensors and protected by intellectual-property laws. These Terms grant you only a limited, revocable, non-transferable, non-sublicensable right to use the service for your personal, non-commercial self-help purposes. You may not: copy the software or content library; create derivative works from the service; resell or commercially exploit the service; scrape or harvest the service or its APIs; or use the service or its outputs to develop, train, or improve a competing product or any AI model. You may freely use the letters and documents generated for you from your own information.
12. Beta Features
We may offer features labeled beta, preview, early access, or similar. Beta features: may change or be discontinued at any time without notice; may contain errors or produce data loss; receive no uptime or support commitment; and are provided AS IS, without warranties of any kind. Use them at your discretion.
13. Service Availability and Changes
We may modify, improve, suspend, or discontinue any feature of the service at any time. We do not guarantee uptime, uninterrupted access, or continuous availability, and we may perform scheduled or emergency maintenance. To the maximum extent permitted by law, we are not liable for any modification, suspension, or discontinuation of the service or any feature. If we discontinue the service entirely, we will provide reasonable notice and the opportunity to export your data as described in the Privacy Policy.
14. Export Controls
You may not use the service in violation of U.S. export control or sanctions laws. You represent that you are not located in a country subject to comprehensive U.S. sanctions and are not on any U.S. government list of prohibited or restricted parties.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Without limiting Section 1: we do not warrant that the service will be uninterrupted or error-free; that AI-generated content will be accurate or complete; that any letter will produce any response or result; or that deadlines, extractions, or educational content are free of errors. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: BeatBullies and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from or relating to the service — including any outcome (or lack of outcome) of any dispute you pursue. Without limiting the foregoing, we will not be liable for: deleted or lost data; corrupted uploads; the acts or omissions of third parties (including postal carriers, AI providers, and recipients of your letters); postal or delivery delays; missed deadlines resulting from inaccurate or incomplete information you provided; errors in AI-generated content you chose to use without verification; or lost opportunities. Our total aggregate liability for all claims will not exceed the greater of (a) the amounts you paid us in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
17. Indemnification
You agree to indemnify and hold BeatBullies harmless from claims and costs (including reasonable attorneys' fees) arising from: your violation of these Terms; your content, including intellectual-property claims arising from materials you upload or send; your violation of any law or regulation; false, fraudulent, or misleading statements or submissions you make; and your misuse of documents generated by the service.
18. Privacy
Our Privacy Policy, available at https://beatbullies.com/privacy, explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
19. Electronic Communications and Signatures
By creating an account, you consent to receive communications from us electronically — including by email, SMS (where you have provided a number), and in-app notices — and you agree that electronic notices, disclosures, agreements, and signatures satisfy any legal requirement that a communication be in writing or signed, consistent with the federal ESIGN Act. You may withdraw SMS consent at any time by replying STOP; service-critical notices will continue by email or in-app.
20. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS. YOU HAVE THE RIGHT TO OPT OUT OF ARBITRATION WITHIN 30 DAYS (SEE SECTION 20.7).
20.1 Talk to us first (informal resolution). Before either of us starts an arbitration or lawsuit, we agree to try to resolve the dispute informally. You or we must first send a written Notice of Dispute — to us at legal@beatbullies.com or Educated Guess Ventures, LLC d/b/a BeatBullies, 333 Tamiami Trl, Venice, FL 34285, or to you at your account email — describing the dispute and the requested resolution. Both parties agree to negotiate in good faith for sixty (60) days from the notice. Most concerns can be resolved this way. An arbitration or court filing made before completing this process shall be stayed until it is completed. Applicable statutes of limitations are tolled during this period.
20.2 Binding individual arbitration. If we can't resolve the dispute informally, you and Educated Guess Ventures, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Claim") will be resolved by binding arbitration on an individual basis, rather than in court, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced (available at www.adr.org). The Federal Arbitration Act governs the interpretation and enforcement of this Section. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this arbitration agreement, except that a court decides issues relating to the class-action waiver in 20.5.
20.3 Exceptions — small claims and injunctive relief. Either party may instead bring an individual Claim in small claims court if it qualifies there. And either party may seek injunctive or other equitable relief in court to protect intellectual property or prevent unauthorized access to or abuse of the Service. Nothing in this Section prevents you from reporting concerns to, or seeking relief from, any federal, state, or local government agency (including your state Attorney General or the FTC).
20.4 Arbitration procedure and costs. Arbitration will be conducted by a single arbitrator, in English, and — at your election — by documents only, by phone/video, or in person in the county where you live. Payment of filing, administration, and arbitrator fees is governed by the AAA Consumer Arbitration Rules; if those rules require us to pay costs, or if the arbitrator finds your Claim was not frivolous, we will pay the AAA filing, administrative, and arbitrator fees. Each side bears its own attorneys' fees unless the applicable law or AAA rules provide otherwise. The arbitrator may award the same individual relief a court could, including statutory damages and attorneys' fees where the law allows.
20.5 Class action and jury trial waiver. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. All Claims must be brought in the parties' individual capacities, not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate more than one person's Claims. If this class-action waiver is found unenforceable as to a particular Claim, then that Claim (and only that Claim) shall proceed in court, and the remainder of this Section remains in effect.
20.6 California consumers. If you are a California resident, then notwithstanding anything else in these Terms: any arbitration of your California-arising Claims will be conducted in California (or remotely at your election), under California substantive law where it applies to you as a consumer, consistent with California Code of Civil Procedure provisions governing consumer arbitration. Nothing in these Terms limits any non-waivable rights you have under California law.
20.7 Your right to opt out. You may opt out of this arbitration agreement entirely — with no effect on any other part of these Terms or your use of the Service — by sending written notice within thirty (30) days of first accepting these Terms to legal@beatbullies.com or Educated Guess Ventures, LLC d/b/a BeatBullies, 333 Tamiami Trl, Venice, FL 34285, including your name, account email, and a statement that you opt out of arbitration. If you opt out (or if you validly opted out of a prior version), disputes will be resolved in court per Section 21.
20.8 Mass filings. If twenty-five (25) or more similar Claims are filed against us by the same or coordinated counsel, the parties agree that the Claims will be administered under the AAA's Mass Arbitration Supplementary Rules and consumer mass-arbitration procedures in effect at the time of filing, including their processes for staged administration and resolution. Statutes of limitations are tolled for Claims awaiting administration under those procedures.
20.9 Severability and survival. Except as stated in 20.5, if any part of this Section is found unenforceable, the remainder remains in effect. This Section survives termination of your account or these Terms.
21. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. This choice of law does not deprive you of the protection of any consumer-protection law of your state of residence that cannot be waived by agreement — those non-waivable protections continue to apply to you.
22. Changes to the Service and These Terms
We may modify the service and these Terms. For material changes, we will notify you (e.g., by email or in-app) and require renewed acceptance where appropriate. The current version and effective date are always available in the app. Continued use after notice of non-material changes constitutes acceptance.
23. Termination
You may close your account at any time (see the Privacy Policy for what happens to your data, including deletion). We may suspend or terminate accounts for violations of these Terms, with notice where practicable.
24. Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including internet or telecommunications outages, cloud or hosting provider outages, AI provider outages, natural disasters, epidemics, government actions, labor disputes, power failures, and cyberattacks.
25. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without your consent in connection with a merger, acquisition, financing, corporate reorganization, or sale of all or substantially all of our assets, with notice to you.
26. Survival
All provisions of these Terms that by their nature should survive termination — including ownership provisions, disclaimers, limitations of liability, indemnification, and dispute resolution — remain in effect after termination of your account or these Terms.
27. Entire Agreement; Order of Precedence
These Terms, together with the Privacy Policy and any additional service-specific or purchase terms we present to you, are the entire agreement between you and us regarding the service. If there is a conflict, the order of precedence is: (1) these Terms; (2) the Privacy Policy; (3) additional service-specific terms; (4) purchase terms. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver.
